Statement condemning intimidation and criminalisation of journalists who are engaged in reporting on Kashmir

On the occasion of India’s 77th Republic Day, the statement below, endorsed by more than 130 journalists and civil society activists across India, marks the precarious state of media freedom in Kashmir.

For some years now, journalists in Jammu and Kashmir have been relentlessly targeted and intimidated. The latest, an attempt to coerce them into signing bonds under the guise of “maintaining peace” has drawn widespread condemnation.

Journalism is not a Crime: Resist Curbs on Media Reporting on and from Jammu and Kashmir

Stop the Silencing, Speak Out

We, the undersigned journalists and civil society members, condemn the relentless manner in which Jammu and Kashmir police and various agencies of the government target, intimidate and seek to criminalise journalists who are engaged in reporting on Kashmir. In particular, we categorically reject recent attempts to coerce journalists into signing bonds, ostensibly to “maintain peace.”

For several years now, journalists reporting on Kashmir, either from the Valley or from elsewhere, have been working under extraordinary pressure, precarious working conditions, low salaries, intense surveillance – both online and offline. They work under the constant threat of criminal charges, show cause notices, arbitrary summons to police stations, detention or arrest under draconian laws. Journalists have found themselves de-boarded from flights, their passports suspended or revoked, and they have been denied the right to move freely or travel in the pursuit of academic or journalistic work. In addition, families of several journalists have been threatened, thus contributing to the atmosphere of intimidation.

In the latest instance, at least six journalists reporting for newspapers headquartered in the national capital New Delhi have been summoned to the Srinagar cyber police station after their reportage on the profiling of mosques, published on January 13, 2026. Some of them were asked to sign a bond under section 126 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 (whereby an Executive Magistrate is empowered to order any person who “is likely to commit a breach of the peace or disturb the public tranquillity or to do any wrongful act that may probably occasion a breach of the peace or disturb the public tranquillity, to execute a bond for up to one year, that they will maintain peace or public tranquility”).

This is a shocking attempt to censor the media. Indeed, the provision itself is a throwback of the good behaviour bonds extracted as a preventive policing measure during the colonial era. Journalists work in the public interest, and we strongly reject any attempt to intimidate them into silence or self-censorship on the specious ground that their reports can “disturb public tranquillity.” Any attempt to force journalists to sign bonds or order them not to report important news is unconstitutional and a direct attack on the fundamental right to freedom of speech and expression.

The Silencing of Journalists in Kashmir

In Kashmir, all attempts have been made to clamp down on independent media, especially after the abrogation of Art.370 of the Indian Constitution in 2019. Efforts by journalists to hold the powerful accountable have been met with a range of repressive measures, including open threats, lawfare and criminalisation. Journalists are charged for their reports or jailed under draconian laws like the Unlawful Activities (Prevention) Act, 1967 and preventive detention laws.

Narratives favourable to the administration are aided by control of print media revenue through a repressive media policy that regulates the dispersal of government advertising. Alongside, the raids on independent media establishments like the Kashmir Times, the shutdown of independent digital media outlets like The Kashmirwalla or Wande Magazine and the jailing of their editors (Fahad Shah, released on bail in November 2023, and Irfan Mehraj, who is still in jail) and writers is an attempt to silence diverse and critical voices crucial to our democracy.

Journalists have a responsibility to investigate and report with accuracy and fairness and to hold truth to power. They have a vital task to put forth the travails of ordinary people and seek accountability from the powerful, especially in zones of conflict. This constant surveillance, intimidatory tactics and attempts to criminalise them will undermine their work and rob society of independent voices that bear witness.

हम, इस बयान के हस्ताक्षरकर्ता और सिविल सोसाइटी सदस्य कश्मीर में रिपोर्टिंग करने वाले पत्रकारों को लगातार निशाने पर रखने और उन्हें धमकाने, पत्रकारिता को अपराध बनाने वाली जम्मू कश्मीर की पुलिस और अन्य सरकारी एजेंसियों की निंदा करते हैं। हम स्पष्ट तौर पर हाल में पत्रकारों से “शांति बनाए रखने के “वचन” वाले बॉन्ड पर हस्ताक्षर करवाने के दबावपूर्ण प्रयासों को खारिज करते हैं।

पिछले कई सालों से कश्मीर पर रिपोर्टिंग करने वाले पत्रकार, घाटी से हों या बाहर से, असाधारण दबाव में काम कर रहे हैं। कार्य स्थितियां शोचनीय हैं, पारिश्रमिक कम, ऑनलाइन और ऑफलाइन निगरानी कड़ी। वह लगातार अपराधिक मामले दर्ज होने, कारण बताओ नोटिस पाने, मनमाने तरीके से पुलिस थानों में बुलाए जाने, कड़े कानूनों के प्रावधानों के तहत हिरासत में लिए जाने और गिरफ्तारी के साए में काम कर रहे हैं।

पत्रकारों को विमानों से उतारा गया है, उनके पासपोर्ट निलंबित/रद्द किए गए हैं और उनके अकादमिक/पत्रकारीय उद्देश्यों से स्वतंत्र रूप से कहीं आने जाने पर बंदिशें लगाई गई हैं। इसके अलावा, कई पत्रकारों के परिवारों को धमकाया गया है और डर का माहौल बनाया गया है।

ताज़ा मामले में, राष्ट्रीय राजधानी नई दिल्ली में मुख्यालय वाले अख़बारों के कम से कम छह पत्रकारों को श्रीनगर साइबर पुलिस थाने में बुलाया गया। उन्होंने 13 जनवरी 2026 को मस्जिदों की प्रोफाइलिंग पर रिपोर्ट प्रकाशित की थी। उनमें से कुछ को भारतीय नागरिक सुरक्षा संहिता (बीएनएसएस), 2023 की धारा के 126 (जिसके अनुसार एक कार्यकारी मजिस्ट्रेट किसी भी व्यक्ति “जो शांति भंग करने या कोई भी ऐसा कार्य कर सकता है जिससे शांति भंग होने की आशंका हो” को एक साल के लिए बांड भरवा सकने में सक्षम है कि वह शांति भंग नहीं करेगा) के तहत एक बांड पर हस्ताक्षर करने को कहा गया।

यह मीडिया को सेंसर करने का भयावह प्रयास है। वास्तव में, यह प्रावधान औपनिवेशिक का में पुलिस के प्रतिबंधात्मक उपायों में से एक था जिसके तहत अच्छे व्यवहार के बांड लिए जाते थे। पत्रकार जनहित में कार्य करते हैं और इस आधार पर कि उनकी रिपोर्ट “सार्वजनिक शांति भंग कर सकती है”, उन्हें ख़ामोश करने के लिए धमकाने या स्व सेंसरशिप के ऐसे किसी भी प्रयास को मज़बूती से ख़ारिज करते हैं। पत्रकारों पर बांड पर हस्ताक्षर करने या कोई महत्वपूर्ण खबर रिपोर्ट न करने के लिए दबाव डालना असंवैधानिक है और अभिव्यक्ति की स्वतंत्रता के बुनियादी अधिकार पर सीधा हमला है।

कश्मीर में पत्रकारों को ख़ामोश करना

कश्मीर में, स्वतंत्र मीडिया का गला घोंटने के, ख़ासकर 2019 में भारतीय संविधान की धारा 370 हटाने के बाद, तमाम  प्रयास किए गए हैं। सत्ता से सच बोलने या उसकी जवाबदेही याद कराने के पत्रकारों के सभी प्रयासों का सामना दमनकारी उपायों से हुआ है। इनमें खुली धमकियाँ, कानूनी एजेंसियों का इस्तेमाल और अपराधीकरण शामिल है। अपनी खबरों के लिए पत्रकारों को गैरकानूनी गतिविधि (रोक) अधिनियम, 1967 जैसे क़ानून व अन्य क़ानूनों के तहत कार्रवाई, हिरासत का सामना करना पड़ा है।

प्रशासन के पक्ष में नैरेटिव को बढ़ावा देने के लिए सरकारी विज्ञापनों के वितरण का नियमन करने वाली दमनकारी मीडिया पालिसी से प्रिंट मीडिया राजस्व पर नियंत्रण किया जा रहा है। इसके साथ कश्मीर टाइम्स जैसे स्वतंत्र मीडिया संस्थानों पर छापेमारी, कश्मीरवाला और वन्दे पत्रिका का बंद होना और उनके संपादकों और लेखकों की गिरफ्तारी (फहद शाह, नवंबर 2023 में जमानत पर रिहा हुए और इरफान महराज अब भी जेल में हैं) लोकतंत्र के लिए महत्वपूर्ण अलग और आलोचनात्मक आवाज़ों को ख़ामोश करने का प्रयास है।

सत्ता से सच कहना और तथ्यपरकता व निष्पक्ष तरीके से खोज करना और रिपोर्ट करना पत्रकारों की ज़िम्मेवारी है। ख़ासकर एक, संकटग्रस्त क्षेत्र में, सामान्य लोगों की पीढ़ा को सामने लाना और शक्तिशाली लोगों से जवाबदेही की माँग करना उनका कार्य है। उनपर लगातार निगरानी, डराये-धमकाये जाने और अपराधीकरण के प्रयास उनके कार्य में बाधा डालेंगे और समाज को स्वतंत्र आवाज़ों से वंचित करेंगे।

हम जम्मू एवं कश्मीर में और जम्मू कश्मीर पर रिपोर्टिंग करने वाले अपने मीडिया साथियों के साथ एकजुट खड़े हैं। हम माँग करते हैं कि उन्हें अपना पत्रकारीय कार्य बिना किसी तरह की रुकावट या बाधा के करने दिया जाए।
